Terms of Service

Acceptance of Terms

By accessing or using the Film Merge website (filmmerge.com), submitting a film, or entering into a distribution agreement with Film Merge, you agree to be bound by these Terms of Service and all applicable laws and regulations.

If you are using Film Merge on behalf of a company, organisation, or production entity, you represent that you have the authority to bind that entity to these terms.

Please read these terms carefully before submitting your film or entering into any agreement with Film Merge. If you do not agree, do not use our services.

Our Services

Film Merge provides film distribution services for Christian and family-friendly content, including:

  • Placement of approved films on global streaming platforms, SVOD, AVOD, and broadcast networks
  • Metadata management and delivery to distribution partners
  • Royalty collection and reporting on behalf of filmmakers
  • Access to a filmmaker dashboard for approved partners

Film Merge acts as a distribution partner and licensing agent only. We do not acquire ownership of any film submitted to or distributed through our platform.

Eligibility

To use Film Merge services, you must:

  • Be at least 18 years of age
  • Have the legal right to submit, licence, and distribute the content you provide
  • Provide accurate and complete information during the submission process
  • Not be prohibited from using our services under applicable law

Filmmaker Terms

Submission

By submitting a film to Film Merge, you represent and warrant that:

  • You own or control all rights necessary to grant Film Merge the right to distribute the film
  • All music, footage, images, and other third-party materials contained in the film are properly licensed for international streaming and broadcast distribution
  • The film does not infringe any third-party intellectual property rights
  • All information provided in your submission is accurate and complete

Distribution Agreement

Distribution of your film through Film Merge is governed by a separate Distribution Agreement signed between you and Film Merge. These Terms of Service apply in conjunction with that agreement. In the event of a conflict, the Distribution Agreement shall prevail.

Your Obligations

As a filmmaker partner, you agree to:

  • Notify Film Merge promptly of any claim, dispute, or legal action concerning the film or its rights
  • Not enter into any distribution agreements for the same territories covered by your Film Merge agreement without prior written consent
  • Provide timely updates to metadata, subtitles, or materials when reasonably requested

Content Standards

Film Merge exclusively distributes Christian and family-friendly content. All films must adhere to the following standards:

  • No explicit language, nudity, or sexual content
  • No content promoting violence, occultism, or anti-Christian ideology
  • No content that targets, demeans, or harms specific religious, ethnic, or social groups
  • Content appropriate for general family audiences or clearly targeted at Christian viewers

Film Merge reserves the right to refuse, remove, or discontinue distribution of any film that does not meet these standards at any time, with notice to the filmmaker.

Misrepresentation of content: Submitting content that does not meet our standards and misrepresenting it as compliant is grounds for immediate termination of the distribution agreement and may result in legal action where applicable.

Intellectual Property

Your Content

You retain full ownership and copyright of your film and all associated materials at all times. Film Merge does not claim ownership of any content submitted to or distributed through our platform.

By entering into a Distribution Agreement with Film Merge, you grant Film Merge a non-exclusive, limited licence to distribute, deliver, and sublicence your film to streaming platforms and buyers, strictly for the purposes and territories defined in your agreement.

Film Merge Property

The Film Merge website, branding, logo, platform tools, and all related intellectual property are the exclusive property of Film Merge. You may not copy, reproduce, modify, or use any Film Merge branding or content without prior written permission.

Revenue Share

Film Merge operates on a revenue-share model. Specific percentages, payment schedules, and reporting terms are defined in your individual Distribution Agreement.

General principles that apply to all distribution partnerships:

  • Film Merge earns only when your film generates revenue — there are no upfront or submission fees
  • Royalty reports are provided on a quarterly basis
  • Payments are made to your registered payment account following receipt of funds from distribution partners
  • Film Merge is not liable for non-payment by third-party platforms, but will pursue recovery on your behalf

Termination

By You

You may request withdrawal from distribution at any time by providing written notice to tosin@filmmerge.com. Film Merge will initiate removal from platforms within 30–60 days of receiving written notice, subject to the terms of existing platform licensing agreements.

By Film Merge

Film Merge may suspend or terminate your distribution agreement with notice if:

  • Your film is found to violate content standards or rights representations
  • You breach any material term of the Distribution Agreement
  • A third-party rights claim is made against the film that cannot be resolved

Effect of Termination

Upon termination, Film Merge will cease active promotion and seek removal of your film from distribution platforms. Royalties earned up to the termination date will be paid in accordance with the Distribution Agreement. Film Merge has no further obligations after final payment.

Disclaimers

Film Merge provides its services on an "as is" and "as available" basis. We make no warranties, express or implied, regarding:

  • Placement on any specific streaming platform or guarantee of acceptance by any platform
  • The volume of views, streams, or revenue your film will generate
  • Uninterrupted or error-free operation of our website or tools

We do not guarantee that any submitted film will be approved for distribution. All submissions are reviewed at our sole discretion.

Limitation of Liability

To the fullest extent permitted by applicable law, Film Merge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising from your use of our services or any distribution agreement.

Film Merge's total liability to you for any claims arising under these terms shall not exceed the total revenue paid by Film Merge to you in the twelve months preceding the claim.

Disputes

These Terms of Service shall be governed by and construed in accordance with applicable law. Any disputes arising from these terms or your use of Film Merge services should first be raised directly with us at tosin@filmmerge.com. We are committed to resolving disputes amicably and in good faith.

If a dispute cannot be resolved through direct communication within 30 days, both parties agree to attempt mediation before pursuing formal legal proceedings.

Changes to These Terms

Film Merge reserves the right to update these Terms of Service at any time. When material changes are made, we will update the "Last updated" date at the top of this page and notify active distribution partners by email.

Continued use of our website or services after changes are posted constitutes acceptance of the updated terms.
